View archived Terms & Conditions — v1.0Albaways is an online marketplace and booking platform connecting customers with independent vehicle rental companies operating in Albania ("Rental Companies"). Albaways may facilitate search, comparison, booking, communication and, where expressly stated, payment services.
Unless expressly stated otherwise, Albaways does not own, lease, operate, maintain, repair or insure the vehicles listed on the Platform and does not provide the underlying vehicle-rental service. The vehicle rental is provided by the Rental Company identified in the Booking.
These Customer Terms govern use of the Platform and the relationship between the Customer and Albaways. The actual rental of a Vehicle is additionally governed by the Rental Agreement and Booking-specific conditions agreed between the Customer and the Rental Company.
"Albaways", "we", "us" and "our" means the operator of the Albaways Platform.
"Customer", "you" and "your" means the person making or using a Booking.
"Platform" means the Albaways website, applications and related digital services.
"Rental Company" means the independent vehicle rental business supplying the Vehicle.
"Booking" means a reservation request or confirmed reservation made through the Platform, as applicable.
"Rental Agreement" means the vehicle-rental agreement between the Customer and Rental Company.
"Vehicle" means the vehicle or vehicle category reserved under a Booking.
"Booking Price" means the price and fees displayed or otherwise agreed for the Booking.
"Deposit" means any security deposit or pre-authorized amount required for the rental.
"Applicable Law" means laws, regulations, mandatory consumer protections and other legal requirements applicable to the relevant party, service or transaction.
The Customer must provide accurate, complete and current information. The Customer must satisfy all age, driving-licence, identification, payment and other requirements imposed by the Rental Company and Applicable Law.
Only persons legally entitled and authorized to drive the Vehicle may do so. The Customer is responsible for ensuring that all additional drivers are declared and accepted before driving.
Albaways may request information reasonably necessary to process a Booking, prevent fraud, verify identity or comply with legal obligations. A Booking may be refused, suspended or cancelled where information is materially inaccurate, fraudulent, incomplete or unlawful, subject to mandatory consumer rights.
Albaways acts as an intermediary marketplace. The Rental Company remains independently responsible for providing the rental service, supplying the Vehicle, maintaining it, assessing damage, administering its deposit, providing rental documentation and complying with its legal obligations.
Albaways may display information supplied by Rental Companies, including vehicle descriptions, photographs, availability, prices, policies and equipment. Albaways takes reasonable steps to present information clearly but does not independently guarantee every item supplied by a Rental Company.
A listing on the Platform is not a representation by Albaways that a Rental Company is owned, employed, endorsed or controlled by Albaways.
A Booking request is not necessarily a confirmed rental. A Booking becomes confirmed when the Rental Company accepts it or the Platform expressly states that it is confirmed.
The confirmation should contain the material Booking information reasonably necessary for the Customer, including rental dates and times, Vehicle or category, price and applicable Booking conditions.
The Rental Company may require presentation of identification, a valid driving licence, a Deposit, execution of a Rental Agreement or other lawful requirements before releasing the Vehicle.
If the reserved Vehicle becomes unavailable, the Rental Company is responsible for any replacement, refund or other remedy required by the Booking, its policies or Applicable Law.
Where a Booking is for a vehicle category rather than a specific registration or individual Vehicle, the Rental Company may provide another Vehicle of the same or an equivalent category, subject to the Booking and Applicable Law.
A substitution that materially reduces the agreed specification should be addressed by the Rental Company through an appropriate alternative, price adjustment or refund where required.
Vehicle availability is subject to the Rental Company's fleet and operational circumstances. Albaways does not guarantee that a particular Vehicle will remain available unless the Booking expressly identifies and guarantees that specific Vehicle.
Prices and mandatory fees should be displayed as clearly as reasonably practicable before confirmation. Additional charges may arise from optional services, Customer conduct, damage, traffic violations, tolls, fuel or charging, late return, recovery or other amounts properly payable under the Booking or Rental Agreement.
Where payment is made directly to a Rental Company, that Rental Company is responsible for the relevant payment, receipt and refund. Where Albaways facilitates payment, payment may be processed through a third-party payment provider and may be subject to that provider's terms.
The Customer authorizes payment of amounts expressly agreed or lawfully due under the Booking. The Customer must not use a payment method without authorization.
Unless otherwise stated, prices are in euros (€). Currency conversion charges imposed by a bank or payment provider are the Customer's responsibility.
If a payment fails, is reversed, disputed or charged back without a valid basis, the Booking may be suspended or cancelled to the extent permitted by Applicable Law.
The Customer must not initiate a fraudulent or abusive chargeback. Nothing prevents a Customer from exercising a genuine statutory right or disputing an unauthorized transaction.
Albaways may provide relevant Booking, payment and communication records to payment providers, financial institutions or competent authorities where reasonably necessary to investigate fraud, disputes or legal compliance.
A Rental Company may require a Deposit or payment-card authorization before releasing the Vehicle. The applicable amount, method and conditions should be disclosed in the Booking or Rental Agreement.
The Deposit may be applied, to the extent permitted by the Rental Agreement and Applicable Law, toward properly established amounts including damage, missing equipment, unpaid rental charges, fuel or charging, late return, traffic fines, tolls, recovery, storage or other valid Customer obligations.
Where the Rental Company holds the Deposit directly, it is responsible for the release or deduction. Albaways is not responsible for funds it did not receive or control.
Where Albaways or its payment provider holds a Deposit, release and deductions will be handled according to the applicable Booking terms, evidence available and Applicable Law.
Cancellation rights and charges are governed by the cancellation terms applicable to the Booking, subject to mandatory consumer rights.
A Customer who does not appear for collection at the agreed time may be treated as a no-show if the Booking terms so provide. Reasonable procedures should be followed for flight delays, late arrival and other circumstances communicated to the Rental Company.
Returning a Vehicle early does not automatically create a right to a refund unless the Booking terms or Applicable Law provide otherwise.
Where a refund is due, the party responsible for the underlying charge is responsible for processing it unless Albaways has expressly undertaken that responsibility.
The Customer must:
The Customer should inspect the Vehicle at pickup and notify the Rental Company of visible damage or missing equipment before departure where reasonably possible. Photographs or other evidence may be used to document the Vehicle's condition.
The Customer must return the Vehicle with the required keys, documents, accessories and equipment and in the condition required by the Rental Agreement, allowing for ordinary wear and tear.
Late return may cause additional rental charges and operational losses. The applicable late-return terms should be disclosed in the Booking or Rental Agreement.
If the Vehicle is abandoned or returned to an unauthorized location, the Customer may be responsible for reasonable recovery, transport, storage and administrative costs to the extent permitted by Applicable Law.
Fuel, charging, mileage limits and operating-cost rules are determined by the applicable Booking and Rental Agreement.
The Customer must return the Vehicle with the required fuel or charge level unless the Booking provides otherwise. Refueling or charging costs and any disclosed service fee may be charged where the Customer fails to comply.
Mileage exceeding an agreed limit may be charged according to the disclosed Booking terms. The Customer remains responsible for road tolls, parking charges and other usage costs attributable to the Customer, subject to Applicable Law.
Unless expressly authorized by the Rental Company, the Vehicle must not be used for:
A breach may result in termination of the rental and charges or loss of contractual protections to the extent permitted by the Rental Agreement and Applicable Law.
Cross-border travel requires the Rental Company's prior authorization and all required documents, insurance and border formalities.
The Customer must not take the Vehicle outside Albania without authorization. The Customer is responsible for complying with the laws of every country visited and for applicable tolls, taxes, permits, border charges and other requirements.
Insurance and roadside assistance may be restricted outside Albania. The Customer must review the applicable cross-border conditions before departure.
In an accident, theft or serious incident, the Customer must prioritize safety, contact emergency services when necessary, contact the police where required, and promptly notify the Rental Company.
The Customer must cooperate with police, insurers, Rental Companies and reasonable investigations, provide accurate information and preserve relevant evidence.
The Customer should not admit liability, settle a claim or authorize substantial repairs without the Rental Company's approval unless necessary to protect life, safety or property.
The Rental Company is responsible for handling the rental-related claim and insurance process where applicable.
If the Vehicle breaks down or becomes unsafe, the Customer must stop safely and contact the Rental Company or its designated assistance provider.
The Customer should not arrange non-emergency repairs without authorization. Where a breakdown results from misuse, negligence, incorrect fuel, unauthorized modifications or another Customer-caused event, reasonable resulting costs may be charged to the Customer to the extent permitted by Applicable Law.
Replacement vehicles, towing, recovery and accommodation arrangements are governed by the Rental Agreement and the circumstances of the breakdown.
The Rental Company may inspect the Vehicle after return and compare its condition with the documented pickup condition.
Where damage is alleged, the Rental Company should, where reasonably available, provide relevant evidence such as photographs, inspection records, repair estimates, invoices or other documentation.
A Customer may dispute a charge and request supporting information. A damage charge must be based on the Rental Agreement, evidence and Applicable Law and must not exceed what is lawfully recoverable.
Reasonable administrative, towing, storage or recovery charges may apply where expressly permitted and properly incurred.
Any insurance, collision-damage protection, excess reduction or other protection offered with a Booking is subject to its specific terms and exclusions.
Common exclusions may include, depending on the product, unauthorized drivers, prohibited use, intentional or reckless conduct, certain interior damage, tires, keys, underbody damage, incorrect fuel, off-road use, cross-border use without authorization or other stated exclusions.
Albaways does not itself provide insurance unless expressly identified as the insurer or provider in the relevant product terms.
The Rental Company is responsible for:
The Rental Company remains responsible for its employees, agents, subcontractors and operational decisions.
The Customer is responsible for fines, penalties, tolls, parking charges and similar amounts arising from the Customer's use of the Vehicle, unless caused by the Rental Company or otherwise allocated by law.
Where the Rental Company receives a notice after the rental, it may identify the Customer or seek reimbursement where legally permitted. A disclosed and reasonable administration fee may apply if permitted by the Rental Agreement and Applicable Law.
Albaways may facilitate communication concerning such charges but does not determine the Customer's legal responsibility for the underlying violation.
Customers are responsible for luggage, valuables, documents and personal belongings. To the maximum extent permitted by Applicable Law, Albaways is not responsible for property left in or around a Vehicle.
The Rental Company may maintain a lost-property procedure. Customers should contact the Rental Company promptly if an item is left behind.
To the maximum extent permitted by Applicable Law, Albaways is not liable for losses arising from the physical rental or operation of a Vehicle where Albaways is not the provider, including vehicle condition, accidents, injury, death, passenger injury, third-party injury, property damage, theft, loss of belongings, breakdowns, delays, substitutions, cancellations by Rental Companies, deposits held by Rental Companies, damage assessments, fines, tolls or recovery costs.
Albaways remains responsible for losses directly caused by its own breach of these Terms, fraud, willful misconduct or negligence to the extent liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limits mandatory rights of consumers.
To the maximum extent permitted by Applicable Law, Albaways' total aggregate liability arising from a specific Booking or use of the Platform shall not exceed the amount actually paid to Albaways by the Customer in connection with that Booking.
To the maximum extent permitted by Applicable Law, Albaways is not liable for indirect, incidental, special or consequential losses, loss of profits, loss of opportunity, loss of anticipated savings or business interruption.
The liability cap and exclusions do not apply to liability that cannot legally be limited or excluded.
Claims concerning accidents, injury, death, vehicle damage, property damage, insurance or other consequences of Vehicle use should generally be directed to the Rental Company, insurer or other responsible party.
Albaways may assist with communication or provide Booking information where reasonably possible, but doing so does not make Albaways responsible for the underlying event.
To the maximum extent permitted by Applicable Law, the Customer is responsible for losses, claims, liabilities, costs and reasonable expenses incurred by Albaways to the extent caused by the Customer's material breach of these Terms, fraud or material misrepresentation, unauthorized driver use, prohibited use, unlawful Platform use or unauthorized cross-border travel.
This provision does not require indemnification for losses caused by Albaways' own unlawful conduct or liability that cannot lawfully be transferred.
Each Rental Company is expected, under its separate commercial agreement with Albaways, to remain responsible for the rental service and to indemnify and protect Albaways against claims, losses, fines, costs and liabilities arising from the Rental Company's vehicles, employees, operations, rental performance, inaccurate listing information, failure to honor a Booking, breach of Applicable Law, insurance failures or other acts or omissions, except to the extent caused by Albaways' own unlawful conduct.
This section describes the intended allocation of responsibility and does not create rights for a Rental Company unless incorporated into the applicable Rental Company agreement.
Albaways aims to maintain reliable Platform operation but does not guarantee uninterrupted, secure or error-free availability.
The Platform may be affected by maintenance, technical failures, internet or telecommunications outages, cyber incidents, third-party services, inaccurate third-party data or other events outside Albaways' reasonable control.
Albaways may modify, suspend or discontinue Platform features where reasonably necessary for maintenance, security, legal compliance or business reasons, subject to mandatory rights.
Payment processors, mapping services, hosting providers, communication services, identity-verification services and other third-party providers may support the Platform.
Third-party services may have their own terms and privacy policies. Albaways is not responsible for independent acts or omissions of third-party providers except to the extent required by Applicable Law.
Albaways may restrict, suspend or terminate Platform access where reasonably necessary because of fraud, unlawful conduct, material breach, abusive behavior, security risk, misuse of the Platform or failure to satisfy applicable Booking requirements.
Where reasonably practicable, Albaways may provide notice and an opportunity to remedy a breach. Immediate action may be taken where necessary to protect Customers, Rental Companies, payment systems, the Platform or comply with law.
Termination does not remove rights or obligations that accrued before termination.
Albaways is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, extreme weather, war, civil unrest, government measures, border restrictions, strikes, epidemics, infrastructure failure, telecommunications failure or major technical incidents.
Nothing in this section removes mandatory consumer remedies.
The Customer agrees that electronic Booking confirmations, notices, messages, payment records, electronic signatures and other electronic communications may be used to document the Booking and communications, subject to Applicable Law.
Electronic records maintained in the ordinary course of business may be relied upon as evidence of communications and transactions, without limiting any right of the Customer to challenge their accuracy.
Rental-service complaints should first be directed to the Rental Company because it provides the underlying rental.
Platform-related complaints may be submitted to Albaways using the contact details published on the Platform.
Albaways may request Booking records, photographs, receipts, communications or other relevant information.
Nothing in this section limits statutory consumer complaint, mediation, administrative or judicial rights.
Albaways processes personal data in accordance with Applicable Law and its Privacy Policy, including Albania's Law No. 124/2024 on Personal Data Protection.
Personal data may be shared with Rental Companies, payment providers, technology providers and other recipients where necessary to process Bookings, provide services, prevent fraud, comply with legal obligations or otherwise as permitted by law.
The Privacy Policy should explain the applicable purposes, legal bases, retention periods, data-subject rights, international transfers, security measures and contact procedures.
The Platform, its software, design, branding, text, graphics and original content are owned by or licensed to Albaways and protected by applicable intellectual-property laws.
Customers may use the Platform for lawful booking purposes. They may not copy, scrape, reproduce, modify, distribute or commercially exploit Platform content without authorization, except where permitted by law.
Nothing in these Terms creates an agency, partnership, joint venture, employment or franchise relationship between Albaways and a Rental Company.
Rental Companies operate independently and remain responsible for their own employees, contractors, taxes, vehicles, insurance and legal obligations.
These Terms are governed by the laws of the Republic of Albania, except to the extent mandatory consumer-protection law provides otherwise.
Subject to mandatory rights to bring claims before another competent authority or court, disputes shall be submitted to the competent courts of Albania.
Albaways may assign or transfer its rights and obligations in connection with a merger, restructuring, sale or transfer of the Platform or business, or as otherwise permitted by law, provided that this does not unlawfully reduce the Customer's mandatory rights.
The Customer may not transfer a Booking where the transfer conflicts with the Booking, Rental Agreement or Applicable Law.
If any provision is found invalid, unlawful or unenforceable, it shall be limited or removed only to the extent necessary. The remaining provisions shall continue in effect.
Where legally possible, an invalid provision shall be interpreted in a manner that most closely achieves its lawful commercial purpose while protecting mandatory consumer rights.
A failure or delay by Albaways to exercise a right does not constitute a waiver of that right. A waiver applies only to the specific circumstance for which it is given and does not prevent future enforcement, subject to Applicable Law.
Provisions concerning payments, liability, indemnification, intellectual property, privacy, disputes, evidence, post-rental charges and other obligations that by their nature should continue after a Booking or termination shall survive to the extent permitted by Applicable Law.
Albaways may update these Terms from time to time. The version applicable to a Booking will generally be the version accepted when the Booking was made, subject to mandatory law.
Where a change materially affects an existing contractual relationship and notice is required, Albaways will provide appropriate notice. No amendment will be used to unlawfully remove mandatory consumer rights.
Customers may use these contact details regarding Bookings, complaints and legal notices.
These Terms, the Booking confirmation, applicable Booking-specific conditions, the Rental Agreement and documents expressly incorporated by reference form the contractual framework applicable to the Customer's use of the Platform and Booking.
For the underlying Vehicle rental, the Rental Agreement between the Customer and Rental Company governs the rental relationship, subject to Applicable Law. If there is a conflict, mandatory law prevails.
No term should be interpreted as removing a right that Applicable Law does not permit the parties to waive.
